PACT Act Info
Where did the PACT Act come from?
The PACT Act (Prevent All Cigarette Trafficking Act) was originally passed in 2009 to prohibit the use of USPS (United States Postal Service) to deliver combustible cigarettes directly to consumers.
In addition to the ban on USPS shipping, the PACT Act required cigarette manufacturers to register with the ATF, file detailed monthly reports with respective state tobacco tax administrators, obtain customer age verification at purchase, and use a delivery method that requires ID and signature of adult customer.
How is vaping effected by the PACT Act?
On December 27th, 2020, buried in the COVID-19 relief bill as part of the “Consolidated Appropriations Act 2021”, Congress amended the PACT Act to include e-cigarettes and all vaping products.
Effective March 28th, 2021, recipients of all vaping product(s) purchased online are required, by law, to present ID and sign for their delivery. The USPS mail ban on vaping products went into effect on April 27th, 2021. After this date, Unique eCigs customers were no longer able to receive vaping products by way of USPS delivery.
Unfortunately, UPS and FEDEX chose to ban the delivery of all direct-to-consumer vaping products as well. This conclusion was not mandated by the government, but decided by each respective carrier.
- FedEx’s vaping product delivery ban: Effective March 1st. 2021
- UPS’ vaping product delivery ban: Effective April 5th, 2021
What this means for Unique eCigs customers...
April 27th, 2021 Unique eCigs shut down their website and stopped shipping to all customers across the country due to the PACT Act and the ban on all shipping via USPS, FEDEX, and UPS.
Since then, we have been patiently searching and waiting for another opportunity to ship products to customers across the United States. FINALLY, we have discovered that opportunity with a warehouse and trucking company based in Las Vegas, NV (RocketShip) who can legally mail packages to local carriers, who then deliver to your door and obtain signature and age verification for delivery!
Since there are so many processes and licenses to acquire in each state, it will take time to broaden our borders. However, we will continually keep adding more and more states and zip codes to our shipping range as time and finances allow!
